Terms of Service

These terms apply when you use the conversion audit tool at audit.theuxhive.com (the "Service"). By creating an account, running a scan or buying anything, you agree to them. Please read section 6 in particular: it explains what the reports are, and what they are not.
1. Who we are
The Service is provided by Carl Borg Bartolo, trading as The UX Hive, a sole trader registered in Malta (VAT number MT29089817) — "we", "us" or "our". You can reach us at carl@theuxhive.com.
2. Who can use the Service
You must be at least 18. If you use the Service for a business, you confirm you're allowed to accept these terms on its behalf, and "you" includes that business. Accounts are for one person or organisation; please don't share or resell access.
3. What the Service does
You give us the address (URL) of a publicly accessible web page. We load that page, take a screenshot, and use artificial intelligence (AI) models to produce a report that scores it on clarity, friction, trust, UX/UI and copywriting and suggests changes. We offer:
- Free — one lite scan a month: scores and findings, plus the fix for the weakest area.
- Full report — a one-off purchase (€29) for one full report with every fix and quick wins.
- Pro — a monthly subscription (€79) with 20 full reports a month and extra features.
We may improve, change or remove features over time. The Fair Use Policy sets out usage limits and forms part of these terms.
4. Your account
Give us accurate details and keep your login secure. You're responsible for what happens under your account. Tell us straight away if you think someone else has accessed it.
5. What you may scan, and how you may use the Service
You may only submit pages that are publicly accessible, and you're responsible for having the right to submit them. You agree not to:
- submit pages behind a login, or pages whose main purpose is to show other people's personal data;
- use the Service for anything unlawful, or to harass, defame or infringe the rights of others;
- access the Service with scripts, bots or scrapers, or try to get around usage limits;
- try to break, overload, copy or reverse-engineer the Service, or extract its prompts or models;
- resell the Service, or present our reports as your own product, unless we've agreed it in writing.
When you submit a page, you ask us to load it on your behalf. If a site blocks us or shows an error page, the scan stops and any credit used is returned.
6. Reports are AI-generated opinions, not guarantees
Reports are produced automatically by AI. That means:
- They can be wrong or incomplete. The AI may misread a page, miss something on it, or make a suggestion that doesn't suit your business. Scores can vary slightly between scans of the same page.
- Estimates are estimates. Any predicted improvement ("estimated lift") is an indication, not a promise. We don't guarantee any increase in conversions, registrations, deposits, revenue or any other result.
- Compliance checks are not legal advice. Reports may point out possible regulatory or advertising-standards issues (for example gambling advertising rules). They are not legal, regulatory or compliance advice, and they don't cover every rule that applies to you. You remain responsible for making sure your website and marketing comply with the law in every market you operate in — please have changes checked by your compliance team or adviser.
- You decide what to change. Use your own judgement, and test changes before rolling them out widely.
7. Prices and payment
Prices are in euro and shown on the pricing page; any VAT due is shown at checkout. Payments are handled by Stripe — we never see your full card details.
- Pro renews automatically every month until you cancel. You can cancel at any time from your account; it stays active until the end of the period you've paid for. Monthly report allowances reset each month and don't roll over.
- Full report credits stay in your account until you use them.
- We may change prices. For Pro, we'll tell you at least 14 days before a new price applies, and you can cancel before it does.
8. Cancellation and refunds
Consumers in the EU normally have 14 days to cancel an online purchase. Because reports are digital content delivered immediately, at checkout we ask you to agree that we start straight away and to confirm you understand that you lose the right to cancel a report once it has been delivered. For Pro, if you cancel within 14 days you may ask for a refund of the subscription fee, less the value of any full reports you've already received.
Otherwise, payments aren't refundable, except where the law requires it or we've made a mistake (for example charging you twice) — contact us and we'll put it right. A scan that fails for a technical reason, or because the site blocked us, uses no credit.
9. Your content and our content
- The Service, its design, software and text belong to us. You get a personal, non-transferable right to use it under these terms.
- You may use your reports freely in your own business, including sharing them with your team, developers and agencies.
- We store your reports and the page text and screenshots we captured so you can see them in your account, and use them to run and improve the Service, as described in our Privacy Policy.
- We won't publish your reports or name your website publicly without your permission.
- If you turn on sharing for a report, anyone with the link can view it until you turn sharing off.
10. Availability
We work to keep the Service available and accurate, but it's provided "as is" and "as available": we can't promise it will always be available, uninterrupted or error-free, or that it will suit your specific needs. If we stop offering a paid feature permanently, we'll refund any unused part of what you've paid for it.
11. Our liability
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law.
Subject to that:
- We aren't liable for loss of profits, revenue, business, opportunity, goodwill or data, for regulatory fines or penalties, or for any indirect or consequential loss — including loss arising from changes you make, or don't make, based on a report.
- Our total liability to you for everything arising from the Service in any 12-month period is limited to the greater of the amount you paid us in that period and €100.
If you're a consumer, we're responsible for loss you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care, and these terms don't affect your legal rights as a consumer.
12. Claims about pages you submit (business users)
If you use the Service for business, you'll cover our reasonable costs of any third-party claim arising from a page you submitted without the right to do so, or from your breach of section 5.
13. Suspension and closing your account
You can close your account at any time from your account page. We may suspend or close an account that breaks these terms, or if we have to by law; where reasonable we'll tell you first. If we close your account without you being at fault, we'll refund any unused part of what you've paid.
14. Changes to these terms
We may update these terms, for example when we add features or the law changes. For important changes we'll tell you by email or in the app before they apply. If you keep using the Service after that, the new terms apply; if you don't agree, you can close your account.
15. Law and disputes
These terms are governed by the laws of Malta, and the courts of Malta can hear any dispute. If you're a consumer living elsewhere in the EU, you also keep the protection of the mandatory laws of your country and can bring a claim there. Please contact us first — most problems can be sorted out quickly.
